  • 1.Parties

    • 1.1.Insurer

      The risk carrier and service provider for travel cancellation insurance, travel interruption insurance, medical travel assistance, delayed luggage insurance, Luggage insurance, collision damage excess waiver on hired vehicles, extended warranty, as well as purchase protection and transport insurance is Redion (Suisse) Assurances SA (hereinafter referred to as Redion or the insurer), with its registered office at Avenue Perdtemps 23, 1260 Nyon, Switzerland.

      The risk carrier and service provider for Contract legal protection, travel legal protection and Telephone legal advice is Fortuna Legal Protection Insurance Company Ltd. (hereinafter referred to as Fortuna or the insurer), with its registered office at Soodmattenstrasse 2, 8134 Adliswil, Switzerland.

    • 1.2.Policyholder

      Viseca Payment Services SA, whose registered office is at Hagenholzstrasse 56, P.O. Box 7007, 8050 Zurich.

      The policyholder may delegate tasks to third parties in accordance with the Conditions of Insurance.

    • 1.3.Card Issuer

      Valiant Bank AG, Bundesplatz 4, P.O. Box, 3001 Bern

  • 2.Premium

    The policyholder shall bear the insurance premium.

  • 3.Type of insurance and insured risks

    All insurance coverage is indemnity insurance. The insured risks are linked to the type of insured card.

  • 4.Start and end of insurance cover

    The insurance cover is valid from the time the card is issued by the card issuer and received by the cardholder. The insurance cover ends

    • with the termination of the card contract between the card issuer and the cardholder;
    • with the exclusion from the collective insurance contract declared by the policyholder;
    • with the termination of the collective insurance contract between the policyholder and the insurer.
  • 5.Statute of limitations and time limit

    Insurance claims expire five years after the occurrence of the event giving rise to the obligation to pay benefits.

  • 6.Obligation in the event of a claim

    • For emergency medical travel assistance and travel interruption insurance services, you must contact the insurer immediately so that the next steps can be determined together and the necessary assistance can be provided. The emergency call centre is available day and night, including Sundays and public holidays (telephone +41 22 939 22 11).
    • In all other cases, please send the necessary claim documents to claims.viseca-business.ch@redion.com or contact the insurer by telephone at +41 22 939 22 11.

  • 7.Restrictions on insurance cover

    In addition to the restrictions and exclusions listed in the “Special provisions for individual insurance coverage”, there is generally no insurance cover:

    • 7.1.In the following cases:
      • abuse of alcohol, drugs or medicines;
      • suicide or attempted suicide;
      • participation in strikes or riots;
      • participation in competitions and training with motor vehicles, snowmobiles or boats;
      • participation in races, rallies or similar competitive or training events with motor vehicles, snowmobiles or motorboats;
      • participation in daring activities in which one knowingly exposes oneself to danger;
      • in the event of grossly negligent or intentional actions/omissions;
      • when committing crimes or misdemeanours or attempting to do so;
      • for activities related to an insured event, e.g. costs for the replacement of the insured items or for police purposes;
      • measures and costs that were not requested or approved by the insurer.
      • where the expert (expert, doctor, etc.) is a direct beneficiary or is related or related by marriage to the insured person;
      • related to war, terrorist attacks, civil unrest of any kind, kidnapping, natural disasters (unless expressly defined as insured in the Special Provisions) and incidents involving nuclear, biological or chemical substances;
      • resulting from official orders, e.g. airport closure/airspace closure, road closures, police measures, orders, etc.;
      • connected to economic, trade or financial sanctions or embargoes in Switzerland that are directly applicable to the contracting parties and conflict with the insurance cover. This also applies to economic, trade or financial sanctions or embargoes imposed by the United Nations, the European Union or the United States of America, provided that they do not conflict with Swiss law.
    • 7.2.For events and their consequences:
      • which had already occurred at the time of booking or purchasing the service to be insured or at the time of joining the insurance. In the case of pre-existing accidents and general, chronic or recurring illnesses, only unexpected, acute deteriorations are insured;
      • the occurrence of which was obvious to the insured person at the time of booking or purchasing the service to be insured or at the time of joining the insurance policy;
      • where the expert (expert, doctor, etc.) is a direct beneficiary or is related or related by marriage to the insured person;
      • related to war, terrorist attacks, civil unrest of any kind, kidnapping, natural disasters (unless expressly defined as insured in the Special Provisions) and incidents involving nuclear, biological or chemical substances;
      • related to epidemics and pandemics, unless expressly defined as insured in the Special Provisions;
      • resulting from official orders, e.g. airport closure/airspace closure, road closures, police measures, orders, etc.;
      • connected to economic, trade or financial sanctions or embargoes in Switzerland that are directly applicable to the contracting parties and conflict with the insurance cover. This also applies to economic, trade or financial sanctions or embargoes imposed by the United Nations, the European Union or the United States of America, provided that they do not conflict with Swiss law.

      The insurer is generally not liable for failure to provide services due to force majeure and can under no circumstances replace the official local providers of emergency services such as the police and fire brigade. If the claim is reported late, the insurer assumes no liability for services that could not be provided on time.

  • 8.Processing of personal data

    Viseca Payment Services SA as the policyholder, the card issuer, and the insurers may engage third parties to fulfill their tasks. The policyholder or card issuer becomes aware of the data of the insured persons to the extent necessary for the careful fulfillment of the assigned tasks in connection with the present insurance. In particular, the insurers may verify with the policyholder or card issuer whether the insured person has insurance coverage at the time of the claim according to the card contract.

    Each contractual party processes personal data in compliance with all applicable data protection regulations.

Conditions of Insurance

Insurers Redion (Suisse) Assurances SA, whose registered office is at Avenue Perdtemps 23, 1260 Nyon, Switzerland and Fortuna Legal Protection Insurance Company Ltd. whose registered office is at Soodmattenstrasse 2, 8134 Adliswil, Switzerland, are hereinafter referred to as the “Insurer”. The Insurer shall provide the card issuer with the agreed services pursuant to the collective insurance policy with Viseca Payment Services SA, hereinafter referred to as the “Policyholder”. These services are defined in these Conditions of Insurance and the provisions of the Federal Insurance Contract Act (ICA). An overview of the services and cards is set out in the Table of Benefits.

    The definitions explain important terms which are set out in italics in the following Conditions of Insurance for easier identification.

    The Table of Benefits displays the insurance coverages included for each type of card, their insured amount, geographical coverage, as well as any requirements regarding card usage.

    The common provisions apply wherever the special provisions do not provide otherwise. In the event of contradictions, the special provisions shall apply.

    The overview of procedures and obligations in the event of a claim shows how to proceed in the event of a claim and which obligations must be complied with. In the event of contradictions, the overview takes precedence over the common and special provisions.

    For the sake of legibility, male and female dual forms are dispensed with.

    In the event of linguistic differences between the French, Italian, English and German Conditions of Insurance, the German version shall always take precedence in case of doubt.

    2. Definitions

    Trip:

    A trip is considered to be a temporary business trip lasting up to 120 calendar days and requiring a professional absence from the place of residence or work, excluding the work commute. This includes a maximum of 14 days off or of holiday taken, directly at the beginning, during or before the end of the business trip.

    Insured company:

    The term “insured company” refers to the party who has concluded a basic contract (corporate master agreement) with the card issuer to acquire corporate or business cards.

    Insured person:

    The insurance covers up to five people (cardholders, employees and non-employees) per card on one trip.

    Switzerland:

    The entire territory of Switzerland, including the territory of the Principality of Liechtenstein.

    Abroad:

    Is any country other than Switzerland and the Principality of Liechtenstein.

    Related persons:

    Spouse, life partner including their parents and children, child (including adoptive and foster child), father, mother, brother, sister, parents-in-law, son/daughter-in-law, grandparents and grandchildren of the insured person.

    Accident:

    An accident is the sudden, unintended harmful impact on the human body of an unusual external factor, which results in an impairment of physical, mental or psychological health or death.

    Serious illness / serious accident:

    An illness or accident which results in a temporary or permanent incapacity to work or which results in a mandatory inability to travel.

    Public transport or means of transport:

    Public transport or means of transport are those means of transport which operate regularly on the basis of a timetable and for which a ticket must be purchased. Private and business jets for which a booking confirmation is in place are covered. Taxis and rental cars shall not be regarded as public transport.

    Personal effects:

    Personal belongings carried by the insured persons.

    Cards:

    All payment cards (including additional cards and foreign currency cards) of the card issuer in accordance with the table of benefits and overview of insurance coverage.

    Travel costs:

    are the total costs of the services booked for transport and accommodation of the insured person, including the costs of chargeable business events (e.g. seminars, conferences, courses and further education) as well as leisure activities booked during the trip (e.g. concerts, events, sporting events, excursions, ski passes, wellness treatments [Treatments ordered by doctors are excluded herefrom]) including administration and handling fees.

    Place of residence:

    The location where the insured person primarily resides and which is considered their main place of residence.

    Country of residence:

    Country in which the insured person is mainly resident and which is considered his/her primary domicile.

    Epidemic / Pandemic:

    A contagious disease recognised as such by the World Health Organisation (WHO) or an official government authority in the insured person’s country of residence or travel.

    Quarantine:

    Compulsory restriction of liberty (including ordered isolation) by order or other requirement of a government or public authority on suspicion that the insured person or a person travelling with or close to the insured person has been exposed to a contagious disease, or purely as a precautionary measure. The aim is to prevent the spread of the infectious disease.

III. Special provisions for individual insurance coverage

II. Common provisions for all insurance coverage

The “Common provisions for all types of insurance coverage” shall only apply insofar as the “Special provisions for individual types of insurance coverage” do not provide otherwise.

  • 1. Start and end of insurance coverage

    The insurance cover is valid from the time the card is issued by the card issuer and received by the cardholder. The insurance cover ends with the termination of the card contract (cancellation by the card issuer, the insured company or by the cardholder) or with the expiration of the card or the exclusion from or termination of the group insurance contract between the policyholder and the insurer.

  • 2. Amendments to the Conditions of Insurance

    The insurance conditions and the insured amounts can be changed at any time. Changes will be communicated to the insured company in a timely and appropriate manner. They are deemed to be approved by the latter unless the card contract is terminated at a date before the change comes into effect.

    There is no obligation to inform the insured company in the event of changes to the insurance conditions that do not have a detrimental effect on the insured benefits.

    The insured company is obliged to inform all cardholders connected to the same credit card contract about the amendments.

  • 3. Limitations of coverage

    In addition to the limitations and exclusions listed in the “Special provisions for individual types of insurance coverage”, as a basic principle no insurance coverage is provided:

    For the following events and their consequences:

    • that had already occurred at the time of booking or purchasing the service to be insured or at the time of taking out insurance, or events whose occurrence was obvious to the insured person at that time. In the case of pre-existing accidents and general, chronic or recurring illnesses, only unexpected, acute deteriorations are insured.
    • Measures and costs that were not requested or approved by the insurer.
    • related to participation in dangerous activities, the risks of which are fully known.
    • related to epidemics, pandemics and quarantines. This restriction does not apply if an epidemic/pandemic results in serious illness or death of the insured person, a related person or representative at the workplace. This restriction does also not apply if an insured person has to go into mandatory quarantine as a result of contact with a sick person.
    • suicide or attempted suicide;
    • participation in strikes or riots;
    • when committing crimes or misdemeanours or attempting to do so;
    • for activities related to an insured event, e.g. costs for the replacement of the insured items or for police purposes;
    • where the expert (expert, doctor, etc.) is a direct beneficiary or is related or related by marriage to the insured person;
    • related to war, terrorist attacks, civil unrest of any kind, kidnapping, natural disasters (unless expressly defined as insured in the Special Provisions) and incidents involving nuclear, biological or chemical substances;
    • resulting from official orders, e.g. airport closure/airspace closure, road closures, police measures, orders, etc.;
    • connected to economic, trade or financial sanctions or embargoes in Switzerland that are directly applicable to the contracting parties and conflict with the insurance cover. This also applies to economic, trade or financial sanctions or embargoes imposed by the United Nations, the European Union or the United States of America, provided that they do not conflict with Swiss law.
    • losses caused by grossly negligent or wilful acts or omissions;
    • losses caused by the abuse of alcohol, drugs or pharmaceuticals;
    • losses arising as a result of participation in races, rallies or similar competitions or training sessions with motor vehicles, motor sleds or motorboats. In the case of travel accident insurance, insurance coverage applies for losses incurred as a result of participation in races, rallies or similar betting or training journeys with motor vehicles, motor sleds or motorboats. This insurance coverage excludes professional sports teams;
    • losses which arise in connection with a completed or attempted wilful criminal act.

    The insurer is generally not liable for failure to provide services due to force majeure and can under no circumstances replace the official local providers of emergency services such as the police and fire brigade. If the claim is reported late, the insurer assumes no liability for services that could not be provided on time.

  • 4. Obligations in the event of a claim

    The beneficiary or insured person (insured company, cardholder, employee or non-employee) is obliged to comply in full with their contractual or statutory duties of reporting, information or conduct. These include:

    • Immediate notification of the insured event
    • Take all necessary measures to reduce the damage and contribute to its clarification
    • Proof of a valid card contract between the insured company and the card issuer
    • Upon request, proof of the professional nature of the trip
    • In case of illness or accident, release the attending physicians from their confidentiality obligation towards the insurer

    If the eligible or insured person can assert benefits provided by the insurer also with third parties, they must preserve these rights and assign them to the insurer.

    If the eligible or insured person does not comply with the obligations to be observed in the event of a claim, the benefits may be reduced or refused, unless it is proven that they failed to meet their obligations through no fault of their own or that the failure had no influence on the damage or the rights and obligations of the insurer.

    If an advance payment has been made, it must be repaid within 30 days.

  • 5. Limitation period

    Claims under the insurance contract become time-barred five years after the occurrence of the event giving rise to the obligation to pay benefits.

  • 6. Subsidiarity clause

    This insurance coverage shall be subsidiary to any other compulsory or optional insurance policies and shall be limited to that portion of the insurance benefits which exceeds or is not covered by the other insurance contract. Costs will only be reimbursed once in total. If the insurer has nonetheless paid benefits for the same loss, they shall be deemed to be an advance and the insured assigns to the insurer any claims it may assert against third parties (mandatory or optional insurance). The subsidiarity clause does not apply to travel accident insurance.

  • 7. Jurisdiction and applicable law

    This Agreement shall be governed by Swiss law. Claims against the insurer may be brought before the court at the Swiss place of residence of the insured person or at the registered office of the insurer.

  • 8. Supplementary legal bases

    In addition to these provisions, the provisions of the Federal Insurance Contracts Act (ICA) shall apply.

  • 9. International sanctions

    Insurers will not provide any coverage, payments, services or other benefits if doing so could expose them to sanctions, prohibitions or restrictions in application of United Nations resolutions or economic sanctions, laws or regulations of the European Union, the United States of America, the United Kingdom, France or the Swiss Confederation. In addition, payments are generally not made in US dollars.

    Territorial exclusion clause:

    Notwithstanding any other provisions, the following countries and territories are excluded from any coverage: Afghanistan, Belarus, Iran, Crimea, North Korea, Russia, Syria, the Donetsk, Kherson, Luhansk and Zaporizhia regions.

    US traveller clause:

    Insurers can only provide insurance coverage to insured persons who are citizens of the United States (US persons) and travel to Cuba and/or Venezuela if the trip complies with US law.

  • 11. Supplementary provisions for legal expenses insurance

    • 11.1. Process buyout

      The insurer has the right to compensate the insured person for his or her economic interest through a buyout instead of the insured benefit, thereby releasing itself from the obligation to provide benefits. The starting point is the material value in dispute, taking into account the litigation and debt collection risks.

    • 11.2. Same event

      If several disputes of a corporate customer are based on the same event or on the same facts, these disputes will be deemed to constitute one legal case.

    • 11.3. Settlement

      The insured person or his/her legal representative may only enter into settlements that involve obligations to the detriment of the insurer with his/her written consent.

      Any legal or party compensation awarded to the insured person in court or out of court is owed in full to the insurer.

    • 11.4. Choice of lawyer
      • The insurer can provide the service through its internal legal department or commission an external service provider to do so.
      • The insured person cannot appoint a legal representative or initiate any legal action or take any legal remedies until Fortuna has given its written or textual consent to do so. Otherwise, the insurer is released from its obligation to provide services.
      • In court and administrative proceedings in which the lawyer’s monopoly applies, or if conflicts of interest make the involvement of a lawyer necessary, the insured person can freely choose a legal representative in agreement with the insurer. The latter must be qualified in the legal field of the procedure and have his or her place of business in the district of the authority responsible for the judicial or administrative procedure. If the insurer rejects the chosen representative, the insured person can propose three other, independent legal representatives, of which Fortuna must choose one.
      • The insured person must release the appointed legal representative from his/her obligation of professional secrecy towards the insurer and must authorise him/her to transmit all documents and information relevant to the case to Fortuna.
      • The insurer may limit and set a time limit on a cost approval, attach requirements or conditions to it and restrict it to individual legal matters or stages of the procedure.
    • 11.5. Differences of opinion
      • If differences of opinion arise regarding the settlement of a legal case or if the insurer refuses to provide a benefit for a measure because it is futile, the insurer must justify its opinion in writing or in text form and inform the insured person of the possibility of using the procedure in the event of a difference of opinion. In this case, the insured person is responsible for observing the legal remedy, forfeiture and limitation periods.
      • If the insured person does not agree with the opinion expressed by the insurer, he or she may submit the matter to a qualified Swiss lawyer or law professor as sole arbitrator within 90 days of receipt of the rejection. The sole arbitrator is appointed jointly by the insured person and the insurer and decides based on a simple exchange of correspondence. He/she will request an advance payment from both sides in the amount of the full estimated costs of the proceedings. No party compensation will be paid. If the insured person does not request such arbitration within 90 days of receipt of the rejection, this is deemed a waiver. Otherwise, the provisions of the Swiss Code of Civil Procedure (CCP) apply.
      • If the insured person initiates legal proceedings at his/her own expense after the insurer has refused to pay the benefit and obtains a more favourable judgement than the opinion communicated by the insurer in writing or in text form or than the result of the arbitration proceedings, the insurer will bear the necessary costs incurred up to the maximum amount of the insured sum.

III. Special provisions for individual insurance coverage

    Extended warranty

    • 1.Description of the coverage

      Damage to newly purchased devices that occurs within the extended warranty period is insured.

    • 2.Scope of application

      • 2.1.Prerequisite

        The insured device

        • must have a purchase price of at least CHF 100;
        • must have been purchased for business purposes and at least 50% paid for with the card;
        • must not be older than four years in the event of a claim;
        • must have a manufacturer’s warranty or dealer’s warranty.
      • 2.2.Duration

        Insurance coverage during the insured extended warranty period begins after the expiry of the manufacturer’s warranty or dealer’s warranty included in the purchase contract. The insured period can be viewed in the Table of Benefits and overview of insurance coverage based on the type of card.

      • 2.3.Geographical coverage

        The insurance applies exclusively to devices purchased from a commercial provider (e.g. shop, mail order company, online store) based in Switzerland or an EU/EEA country.

      • 2.4.Insured devices and accessories
        • Electrical household appliances (so-called “white goods”) such as dishwashers, cookers, ovens, microwaves, refrigerators,
        • Electronic entertainment devices (so-called “brown goods”) such as televisions, projectors, DVD/Blu-ray players, hi-fi systems, MP3 players, photo cameras, video cameras, GPS devices,
        • Electrical communication devices (so-called “grey goods”) such as mobile phones, tablets, wearables, computers, notebooks, printers, copiers, fax machines, scanners, external hard disks.
        • Accessories for the corresponding devices (e.g. adapters, cables and transformers) are also insured.
    • 3.Insured events

      The conditions and events for providing the guarantee are the same as those in the manufacturer’s warranty.

    • 4.Insured benefits

      The direct costs incurred for repair or replacement of an insured device are paid.

      Compensation is up to the maximum insured amount according to the Table of Benefits.

    • 5.Restrictions

      In addition to Section II 3, the following is not insured:

      • any incident resulting from use not in accordance with the manufacturer’s instructions;
      • any event resulting from inadequate maintenance, oxidation or normal wear and tear;
      • any event subject to external influences;
      • any event that leads to a recall of the item by the manufacturer;
      • any event which gives rise to the liability of a third party or which is attributable to intentional negligence;
      • scratches, chips, scrapes and, more generally, any damage to the casing of the insured object that does not affect its functionality;
      • all gas-powered items;
      • all rented or leased items;
      • any items to which modifications have been made not approved by the manufacturer;
      • costs of estimates and inspections, whether or not they are followed by repairs, as well as repair costs incurred directly by the insured person without the prior consent of the insurer;
      • delivery and assembly costs;
      • medical devices;
      • motor vehicle

    Purchase protection and transport insurance

    • 1.Description of coverage

      Damage to and theft of purchased items shall be insured for the first 30 days after purchase.

    • 2.Area of validity

      • 2.1.Requirement
        • The insured item must have been purchased brand new for business purposes and at least 50% paid for using the card.
        • The value of the goods must be at least CHF 50.
      • 2.2.Duration

        In the case of online purchases, the insurance coverage commences with the dispatch of the goods and otherwise with the transfer of the goods to the cardholder.

        The insurance coverage lasts for 30 days from the time the recipient took possession of the insured goods.

      • 2.3.Geographical coverage

        Worldwide

    • 3.Insured events

      Damages related to the insured item shall be insured as a result of the following events:

      • robbery (theft with the threat or use of violence against the insured person);
      • theft;

      destruction or damage;

      • non-delivery or incorrect delivery in the case of online purchases;
      • non-acceptance of returns in the case of online purchases.
    • 4.Insured benefits

      • In the case of robbed, stolen or destroyed items, the Insurer may choose to replace the item in kind or reimburse the purchase price paid.
      • In the case of damaged items, the repair costs shall be covered up to the replacement value at most.
      • In the case of non-delivery of items purchased online, the purchase price shall be paid.
      • In the case of non-acceptance of the return of goods by the vendor despite the customer’s right of return, the purchase price shall be paid.
      • If an item is not delivered in accordance with the contract, the postage costs incurred for returning the item to the seller shall be covered. If the seller refuses to provide a replacement or issue a refund, the purchase price shall be paid.

      In the case of items belonging to a pair or a set, the full purchase price shall be refunded, provided that the undamaged items are unusable on their own or cannot be replaced separately.

      The compensation shall not exceed the insured sum according to the Table of Benefits.

    • 5.Restrictions

      In addition to Section II 3, the following shall not be insured:

      • normal wear and tear;
      • manufacturing or material defects;
      • operational errors;
      • temperature influences and weather conditions;
      • items belonging to the following categories:
      • cash, cheques, traveller’s cheques, all other securities, admission tickets and other vouchers, coins, medals, loose gemstones, pearls and precious metals in the form of inventories, ingots or commodities;
      • jewellery and watches, precious metals and gemstones, unless they are being worn or used for their intended purpose or are in the personal possession of the cardholder;
      • motor vehicles;
      • animals and plants;
      • consumer and perishable goods with a limited service life, e.g. foodstuffs, cosmetics;
      • items acquired through fraudulent or unauthorised use of the card;
      • damage caused as a result of strikes, lockouts or sabotage on the part of service providers or carriers;
      • purchases from a peer-to-peer platform or auction platform or from a company not liable for VAT;
      • damage for which a third party, as the manufacturer or seller, is contractually responsible owing to a repair order.
      • delivery and assembly costs are not covered.
      • delivery of a product that does not conform to the description of the product’s condition.
      • second-hand products (artworks are not considered second-hand products) and used goods.
      • events related to the insolvency of the supplier/seller.

    Telephone legal advice

    • 1.Description of the coverage

      Telephone legal advice service for selected legal matters is covered.

    • 2.Scope of application

      • 2.1.Duration

        Coverage is provided for legal issues reported during the period of validity of the insurance cover. The decisive factor is the time of the event triggering the need for advice.

      • 2.2.Geographical coverage

        Insurance cover is provided for legal issues for which the place of jurisdiction is Switzerland and Swiss law applies.

    • 3.Insured legal matters

      The protection of legal interests in the following legal matters is covered:

      • Contract law
      • Employment law
      • Tenancy law
      • Insurance law
      • Civil damages law
      • Criminal law
    • 4.Insured benefits

      Three telephone legal consultations per insurance year are covered. The legal consultation is carried out by the insurer’s internal legal service and includes the following:

      • Assessment of the legal situation and chances of success.
      • Recommendations on the further legal procedure.
      • Referral to legal representatives.

      The maximum duration per legal consultation is one hour. Consultation hours cannot be accumulated for an insured company with multiple cards. For each insured company, coverage is limited to three consultation hours.

    • 5.Restrictions

      In addition to Section II 3., the following is not insured:

      Disputes related to the parties mentioned in section 1 of the customer information.

    Contract legal protection

    • 1.Description of the coverage

      The protection of legal interests in disputes relating to purchased items and services is covered.

    • 2.Scope of application

      • 2.1.Prerequisite

        The physical item must have been purchased for business purposes, be brand new and at least 50% paid for with the card. The value of the goods must be at least CHF 50 excluding delivery and assembly costs.

        The service purchased must have been for business purposes and at least 50% paid for with the card.

      • 2.2.Duration

        Coverage exists for legal cases that occur during the period of validity of the insurance cover. The relevant point in time is defined as follows: Time of the actual or alleged breach of law.

      • 2.3.Geographical coverage

        Worldwide provided that due process is guaranteed in the country in question and the judgement is enforceable in that country.

    • 3.Insured legal matters

      The protection of legal interests in disputes arising from private law purchase and service contracts is covered.

    • 4.Insured benefits

      The insurer covers the following benefits up to the maximum insured amount according to the Table of Benefits:

      • Processing of the legal case and representation by the internal legal department.
      • Costs of a lawyer or legal representative.
      • Court and other procedural costs.
      • Reimbursement of litigation costs to the other party.
      • Costs for reports and expert opinions ordered by Fortuna or by the courts.
      • Costs for mediation proceedings agreed with Fortuna or ordered by a Swiss court.
      • Collection costs for claims awarded in an insured legal case. These are only covered until a seizure loss certificate or bankruptcy notice is issued.
      • Necessary travel and translation costs for legal proceedings abroad.
    • 5.Restrictions

      In addition to Section II 3, the following is not insured:

      • Fines, contractual penalties and other payments of a punitive nature imposed on the insured person.
      • Payable compensation of any kind.
      • Costs that others would have to pay if this legal protection insurance did not exist.
      • Disputes over claims that have been assigned or transferred to an insured person or a third party after the occurrence of the insured event.
      • Disputes relating to contracts involving real estate and land ownership.
      • Disputes relating to the seizure of objects.
      • Disputes relating to legal transactions in the financial sector (in particular banking, stock exchange, futures, financial, investment and speculative transactions), in connection with the investment and management of assets.
      • Disputes arising from mandate relationships with lawyers, tax advisors, notaries, trustees, accountants and auditors.
      • Legal cases that arose, were known or could have been known before the insurance came into effect.
      • Disputes related to the parties mentioned in section 1 of the client information.

IV. Procedures and obligations in the event of a claim

For emergency services provided by medical travel assistance and travel interruption insurance, you must contact the insurer immediately so that the next course of action can be determined jointly and the necessary assistance can be provided. The emergency call centre is at your disposal day and night, including on Sundays and public holidays (telephone +41 22 939 22 11).
